District Court Judge in Bloomfield Hills, Michigan Finds Prejudice when Drunk Driving Case Set for Trial Then Dismissed"},"content":{"rendered":"<p>The Barone Defense Firm recently handled a drunk driving case in Bloomfield Hills 48<sup>th<\/sup> District Court.\u00a0 The case involved a person who was stopped for weaving and running a red light.\u00a0 According to the police officer, this driver failed the field sobriety tests, and was arrested.\u00a0 He later had his blood drawn, and the result of the blood test suggested a bodily alcohol level of .136 grams of alcohol per 100 milliliters of blood.\u00a0 The driver had been arrested for DUI previously, so this was his second offense.<\/p>\n<p>This second offense drunk driving was prosecuted by the Oakland County Prosecuting Attorney\u2019s office.\u00a0 As is typical for this prosecutor, no deals were offered so the matter was set for trial. \u00a0A few days before the trial date the prosecutor filed a \u201c<a href=\"https:\/\/www.law.cornell.edu\/wex\/daubert_standard\" target=\"_blank\" rel=\"noopener noreferrer\">Daubert<\/a>\u201d motion, arguing that the defendant\u2019s expert was unqualified and should not be able to offer his opinion at trial that the blood test result was flawed, inaccurate and unreliable.\u00a0 The motion was scheduled for the first day of trial.<\/p>\n<p>On the first day of trial, the assistant prosecutor handling the case indicated to the judge that she had no witnesses and could not proceed.\u00a0 Accordingly, she asked the judge to dismiss the case.\u00a0 We had no objection to the dismissal, so long as it was \u201cwith prejudice.\u201d\u00a0 The assistant prosecutor asked that it be without prejudice.\u00a0 In this context, legal \u201cprejudice\u201d essentially means \u201cfinal determination.\u201d\u00a0 Said differently, we were arguing that jeopardy should attach so that the case could not be tried at a later date.\u00a0 Jeopardy arises out of the Fifth Amendment to the Constitution, which indicates &#8220;[N]or shall any person be subject for the same offense to be twice put in jeopardy.\u201d<\/p>\n<div class=\"read_more_link\"><a
