href=\"https:\/\/www.theguardian.com\/us-news\/2016\/dec\/24\/california-dui-caffeine-lawsuit-solano-county?utm_source=feedburner&amp;utm_medium=feed&amp;utm_campaign=Feed%3A+quicksnailsfeed+%28quicksnailsfeed%29\" target=\"_blank\" rel=\"noopener noreferrer\">under the influence of caffeine<\/a>.\u00a0 The officer who pulled the man over was working on alcohol enforcement when the driver pulled in front of him, cutting him off, and then driving erratically.\u00a0 A roadside breath test showed no alcohol was present in the driver\u2019s body.\u00a0 18 months later, a blood test was produced only showing the presence of caffeine.\u00a0 Apparently, a motion to dismiss was denied and the case set for trial.<\/p>\n<p>While this case appears to be first of its kind, it\u2019s not likely to be the last.\u00a0 In California, like Michigan, it is unlawful to drive under the influence of any drug, including alcohol.\u00a0 The term \u201cdrug\u201d is very broadly defined, and therefore can include caffeine and even less \u201cintoxicating\u201d substances like ginseng.<\/p>\n<p>This is because, as previously discussed, Michigan\u2019s definition of drug includes even things listed in the homeopathic pharmacopoeia.\u00a0 Specifically, Michigan\u2019s drunk driving statute, MCL 257.625(25) indicates that an intoxicating substance means: any substance, preparation, or a combination of substances and preparations other than alcohol or a controlled substance, that is either of the following:<\/p>\n<div class=\"read_more_link\"><a
