{"id":368,"date":"2016-09-02T00:00:00","date_gmt":"2016-09-02T04:00:00","guid":{"rendered":"http:\/\/baronedefensefirm.lawblogger.net\/blog\/drunk-drivings-grisly-toll-justifies-warrantless-searches-of-motorists-breath\/"},"modified":"2022-10-04T13:40:52","modified_gmt":"2022-10-04T17:40:52","slug":"drunk-drivings-grisly-toll-justifies-warrantless-searches-of-motorists-breath","status":"publish","type":"post","link":"https:\/\/www.baronedefensefirm.com\/blog\/drunk-drivings-grisly-toll-justifies-warrantless-searches-of-motorists-breath\/","title":{"rendered":"Drunk Driving\u2019s Grisly Toll Justifies Warrantless Searches of Motorist\u2019s Breath"},"content":{"rendered":"<p>Citing the \u201cgrisly toll on the Nation\u2019s roads,\u201d and by opinion dated June 23, 2016, the United States Supreme Court has ruled that the police are not required to obtain a warrant in order to obtain a breath sample.\u00a0 The same is not true of blood test where warrants are still required.\u00a0 Fundamental to the Court\u2019s analysis is their finding that breath testing is non-invasive, and can therefore be conducted as a \u201csearch incident to arrest.\u201d \u00a0The name of the case is Birchfield v. North Dakota.<\/p>\n<p>The Court\u2019s opinion begins with a brief history of drunk driving and the evolution of breath testing to its current incarnation \u2013 infrared spectroscopy.\u00a0 Included in this history is the fact that the Nation\u2019s first \u201clegal limit\u201d was 0.15%.\u00a0 The legal limit was later dropped to 0.10% and then dropped again to the current National standard of 0.08%.<\/p>\n<p>The Birchfield opinion embraces and discussed three separate but related cases as follows:<\/p>\n<div class=\"read_more_link\"><a
