{"id":443,"date":"2017-04-11T00:00:00","date_gmt":"2017-04-11T04:00:00","guid":{"rendered":"http:\/\/baronedefensefirm.lawblogger.net\/blog\/oakland-county-circuit-court-judge-throws-out-20-breath-test-on-felony-drunk-driving\/"},"modified":"2025-01-08T14:39:33","modified_gmt":"2025-01-08T18:39:33","slug":"oakland-county-circuit-court-judge-throws-out-20-breath-test-on-felony-drunk-driving","status":"publish","type":"post","link":"https:\/\/www.baronedefensefirm.com\/blog\/oakland-county-circuit-court-judge-throws-out-20-breath-test-on-felony-drunk-driving\/","title":{"rendered":"Oakland County Circuit Court Judge Throws out .20 Breath Test on Felony Drunk Driving"},"content":{"rendered":"<p>An Oakland County Circuit Court Judge recently suppressed a DataMaster .20 evidentiary breath test result on a felony drunk driving case.\u00a0 The judge suppressed the breath test because the police officer who administered the test failed to follow the laws and rules intended to assure that breath tests are reliable.\u00a0 Because of the judge\u2019s ruling, the prosecutor can no longer argue to the jury that the driver had an unlawful bodily alcohol level (UBAL).<\/p>\n<p>The facts, in this case, are as follows: the driver was stopped for making an unlawful turn.\u00a0 The driver had no valid driver license, smelled of alcohol and admitted drinking.\u00a0 Subsequently, the driver was unable to perform to the police officer\u2019s satisfaction on the field sobriety tasks, including the alphabet, backward count, heel to toe and horizontal gaze nystagmus.\u00a0 This driver had two or more prior DUIs in his lifetime.\u00a0 Based on Heidi\u2019s law, with at least two lifetime prior DUIs, this arrest would <a href=\"#\">make it a felony<\/a>. \u00a0A roadside preliminary breath test indicated .123 on a \u201cweak\u201d sample.\u00a0 Thereafter the driver was arrested for felony drunk driving.<\/p>\n<p>Because this was a felony case, the driver was entitled to a probable cause hearing.\u00a0 In Michigan, this is called an evidentiary hearing.\u00a0 At an evidentiary hearing, the prosecutor bears the burden of proof, but only by the standard of probable cause.\u00a0 This means prosecutor need only show, through witnesses and evidence, that the crime charged was probably committed.\u00a0 Because of this, an evidentiary hearing is a much-abbreviated version of trial.\u00a0 Nevertheless, at the evidentiary hearing, we did ask the police officer some general questions about his observation of the driver prior to the breath test.
