Types of Protective Orders

Michigan protective orders usually cover domestic scenarios where there is a prior relationship, maybe a marriage, a dating relationship, or someone who lives with a person or in a home and for whatever reason, they are fearful that that person might cause them harm, but they also cover non-domestic relationships as well. There are three important types of protective orders in Michigan, domestic, stalking, and nondomestic. Restrictions and regulations can be serious for the various orders, so it is important to understand early on so there are no additional penalties for violation. Domestic Personal Protection

There are three types of personal protection orders in Michigan, the first one is a domestic personal protection order, which is the type of order that someone would want to get if they are fearful that a spouse or former spouse might hurt them that they need protection from that person or someone with whom they have a child in common so they do not have to be married but if they had a child in common, they can get a domestic protective order against them, also it can be someone with whom a person just has a dating relationship with or has had a dating relationship in the past. Also, a domestic protective order in Michigan can cover just somebody who is not related to a person in any way, that they had never dated, they are not married to them, they do not have children, but they just live together.

As part of a PPO, a person can ask for a judge to keep another person from contacting them in any way, meaning they cannot come within a certain distance of their home or contact the other party by phone or by text or by email. On the other hand, there is also what is called a stalking protective order, if a person is fearful that another person is literally stalking them either on the internet or a person is following them around or in some other way intimidating, threatening, or harassing them, then a judge can order an anti-stalking PPO.

All a person needs to do is show that that person is interfering with their personal space or freedom or that they have threatened them or caused the person to feel in fear of being harmed and if that is true then they can show reasonable cause and they can get this type of Michigan domestic protective order.


The second PPO in Michigan is what is referred to as a stalking PPO, a stalking PPO is the type of PPO that a person would get for someone who does not fit into the domestic PPO categories so they do not have to have any relationship with them at all and they do not have to live with them, but for whatever reason they are making them feel threatened, frightened, harassed, or molested or they are following them around or maybe stalking on the internet, they show up in odd places and they are doing things without any consent and it is causing the person to feel afraid.

Neither of those types of Michigan PPOs would be available against the minor child, the minor child is not covered by these things and obviously, it is a rare circumstance but there are situations where a minor child might face them. These types of PPOs do not cover those scenarios, they must pursue that type of belief in a different way.

Non-Domestic Sexual Assault Protection

There is also a type of Michigan protective order that relates to sexual assault and it is a called non-domestic sexual assault protective order and the purpose of that is the protected person or someone else who has either been convicted of sexually assaulting a person or has threatened to do so, but they do not have a relationship with them, a domestic relationship with them, they do not live with them, they have never been married to them, if they have not even ever dated them but they are fearful that they may try to sexually assault them.

The protective order in that instance can keep a person from entering a person's residence, from threatening them in any way, from buying a gun, and from being able to interfere with their children, job, or school, following them around, appearing within their sight, calling them, and sending them an email or text messages.
